Driving While Distracted

As most of us are aware, the State of Florida has very strict DUI laws. The financial penalties are substantial and the insurance requirements are the most stringent in the United States of America. Only the Commonwealth of Virginia has similar insurance laws, including the FR44 filing requirement.
The FR44 is an auto insurance filing requirement mandated by the State in order for a driver who has been convicted of a DUI to regain their license, registration and tag. In Florida, the bodily injury limit requirements are $100,000 per person, $300,000 per occurrence and $50,000 for property damage to others. Failure to maintain an FR44 for the mandated period of time will result in either suspension of drivers license and registration or a possible revocation for individuals who have a history of failure to maintain the certificate as required by law.
What is absolutely inconceivable is that Florida, unlike most other States, does not have distracted driving laws! I see people texting and driving every day during my daily commute. Our neighboring States, Georgia and Alabama, have laws restricting mobile phone use, especially text messaging. Florida has a population of over 19 million people, yet has not initiated any such laws whatsoever. Statistics clearly show that distracted driving, especially due to the use of a mobile phone or device, has an equivalent (if not greater) frequency of occurrence compared to that of DUIs.We should consider enacting similar laws placing restrictions on the use of mobile devices while operating motor vehicles.
Most DUI occurrences are not repeat offenders. Oftentimes someone is stopped for a minor traffic violation (such as a broken taillight) and the situation turns into a DUI violation. Someone may stop at their favorite restaurant during “happy hour” on the way home from work and end up driving a vehicle with a blood alcohol level above 0.08% (the legal limit) after a burger and a beer. In no way am I condoning driving a motor vehicle after ingesting ANY amount of alcohol. What I am stating is that DUIs happen to good people. If the laws are so stringent for DUI (as they should be), we should also consider similar penalties for DWD, or “driving while distracted”.
As we approach the Thanksgiving holiday, it is important to note that, historically, Thanksgiving is the most dangerous and deadly day of the year in regards to drunk driving. We hope in 2016 the issue of distracted driving is addressed responsibly. It is my opinion that the penalties should be equivalent to those of a DUI as the impairment is equivalent to that of drunkenness.
